基心AI服务条款Jixin AI Terms of Service

欢迎使用 基心AI（Jixin AI）。您访问或使用本服务，即表示您已阅读、理解并同意本服务条款。

合同相对方为 一心一意（杭州）企业管理有限公司（「我们」或「平台方」）。隐私处理规则见 《隐私政策》，构成本条款的相关文件。

本服务可能包括（以实际开通与页面展示为准）：

• AI 内容生产、视频与素材管理；
• 多平台账号绑定、自动发布与定时任务；
• TikTok Content Posting：Upload API（video.upload，视频进入收件箱由您在 TikTok 内完成）与 Direct Post（video.publish，仅在您确认后发送）；
• 抖音开放平台 H5 投稿及相关能力；
• 抖音 / 快手 / 小红书 / 视频号等国内平台扫码会话发布。

TikTok、抖音、YouTube 等第三方平台不是我们控制的服务。我们不是 TikTok 官方产品，也不声称获得 TikTok 官方背书。平台 API、配额、审核政策与可用性可能随时变化。

• 您应提供真实、准确的注册与联系信息，并及时更新；
• 妥善保管验证码、会话与设备，对账号下操作负责；
• 禁止共享他人平台授权或冒用他人账号；
• 发现异常授权或登录时，应立即在平台侧撤销授权、在本服务中解绑，并联系 wangzhenyong@shuyunpingtai.com。

您保留对合法拥有内容的权利。

您授予我们一项有限、非独占、可撤销的许可，仅为存储、转码、预览以及按您的指令向指定平台发布所必需而使用相关内容。该许可不扩大为任意商业利用或模型训练，除非您另行明确同意。

解绑或删除后，该许可终止；但为履行法律义务、解决争议、安全审计或备份延迟清除所必需的情形除外。

您保证：

• 对视频、图片、音乐、声音、肖像、商标与文案拥有必要权利或授权；
• 内容不侵犯版权、肖像权、隐私权及其他合法权益；
• 商业内容按 TikTok / 各平台规则进行披露；
• 不发布违法、欺诈、骚扰、仇恨、成人、危险或垃圾内容；
• 不通过本服务复制、搬运无权使用的第三方平台内容。

• 发布前必须由您选择具体账号与视频；
• 展示视频预览与可编辑发布文案；
• TikTok 隐私级别不得由我们擅自预设为公开；须由您从 creator_info 返回的选项中主动选择；
• Comment、Duet、Stitch 等默认不得替您勾选，并应服从创作者账号能力；
• 须经您明确确认后才向平台发送内容；
• 商业内容声明、音乐使用确认与品牌内容规则按 TikTok 等平台最新要求展示（如适用）；
• 您对发布内容拥有最终控制权；我们不承诺审核后一定能公开发布。

• 您同时受 TikTok、抖音、YouTube 等平台条款与政策约束；
• 平台可以拒绝、限制、延迟、删除内容或暂停账号；
• 我们不得也不会声称获得 TikTok 官方背书；
• 平台 API、配额、审核政策与可用性可能变化，我们不保证始终可用。

• 绕过授权、滥用 API、批量垃圾发布；
• 非法抓取、出售或分享平台数据；
• 上传恶意代码或破坏服务安全；
• 冒充他人或侵犯第三方权利；
• 使用无权访问的账号或内容。

本服务提供免费档与付费合伙人/充值能力。默认展示的年付套餐示例包括：基心AI成长官（约 960 元/年）、基心AI创作官（约 3600 元/年）、基心AI智创官/智创合伙人（约 9600 元/年），具体以支付页与总后台当时展示的价格、权益与算力点发放为准。

计费周期、发票/税费、退款与续费规则以您下单时页面展示及适用法律为准。付费合伙人超出免费额度后，部分能力可能按算力点等虚拟权益扣减。我们不在本条款中虚构未上线的收费项目。

• 我们可能因维护、升级、不可抗力或第三方 API 变化而中断或调整服务；
• 您可随时停止使用并解绑平台账号；
• 严重违规时，我们可暂停或终止服务并保留依法追责的权利。

• 基心AI 产品、界面、品牌、文案与代码等权利归平台方或权利人所有；
• 用户内容权利归用户或其合法权利人；
• TikTok、YouTube、抖音等名称与商标归各自权利人所有，本条款中的提及仅为说明用途。

• 不承诺所有发布都成功、即时可见或获得流量；
• 不承诺平台审核一定通过或内容保持公开；
• AI 生成内容可能不准确，重要事项请人工核验；
• 在法律允许的最大范围内，我们对间接损失、预期利益损失等不承担责任；法律禁止排除的责任除外。

本条款不构成收益承诺、效果保证或虚假宣传。

因您违反本条款、侵犯第三方权利或滥用服务导致我们遭受损失的，您应赔偿我们因此产生的合理损失与费用。

本条款的订立、效力、解释与履行适用中华人民共和国法律。因本条款引起的争议，双方应友好协商；协商不成的，提交平台方所在地有管辖权的人民法院诉讼解决。

Welcome to Jixin AI (基心AI). By accessing or using the service, you agree to these Terms of Service.

The contracting party is 一心一意（杭州）企业管理有限公司 (“we”). Privacy practices are described in the Privacy Policy, which is incorporated by reference.

Depending on your plan and UI, services may include:

• AI content production and media management;
• Multi-platform account linking, auto-publish, and scheduling;
• TikTok Content Posting: Upload API (video.upload, inbox draft for in-TikTok completion) and Direct Post (video.publish, only after your confirmation);
• Douyin Open Platform H5 publish flows;
• QR-session publishing to Douyin, Kuaishou, Xiaohongshu, and WeChat Channels.

TikTok, Douyin, YouTube, and similar platforms are not controlled by us. We are not an official TikTok product and do not claim TikTok endorsement. APIs, quotas, review policies, and availability may change.

• Provide accurate registration and contact information and keep it updated;
• Protect verification codes, sessions, and devices; you are responsible for activity under your account;
• Do not share others’ platform authorizations or impersonate others;
• If you see abnormal access, revoke on the platform, unlink in our product, and contact wangzhenyong@shuyunpingtai.com.

You retain rights in content you lawfully own.

You grant us a limited, non-exclusive, revocable license to store, transcode, preview, and publish content solely as needed to follow your instructions. This license does not expand to unrestricted commercial use or model training unless you separately consent.

The license ends after unlink/deletion, except where retention is required for law, disputes, security, or backup lag.

You warrant that:

• You hold necessary rights for videos, images, music, voice, likeness, marks, and copy;
• Content does not infringe IP, publicity, privacy, or other rights;
• Commercial content is disclosed per TikTok and other platform rules;
• You will not post illegal, fraudulent, harassing, hateful, adult, dangerous, or spam content;
• You will not use the service to copy platform content you are not entitled to use.

• You must select the account and video before publishing;
• We show previews and editable captions;
• TikTok privacy level is not preset by us to public; you choose from options returned by creator_info;
• Comment, Duet, and Stitch are not checked by default and follow creator capabilities;
• Content is sent only after your explicit confirmation;
• Commercial disclosure, music confirmations, and branded-content rules follow current platform requirements where applicable;
• You retain final control; we do not promise public visibility after review.

• You remain bound by TikTok, Douyin, YouTube, and other platform terms;
• Platforms may refuse, limit, delay, remove content, or suspend accounts;
• We do not claim official TikTok endorsement;
• APIs, quotas, and policies may change; continuous availability is not guaranteed.

• Bypassing auth, abusing APIs, or mass spam publishing;
• Unlawful scraping, selling, or sharing platform data;
• Uploading malware or compromising security;
• Impersonation or infringement of third-party rights;
• Using accounts or content without authorization.

The service offers free tiers and paid memberships/top-ups. Default annual plan examples include Growth (~CNY 960/year), Creator (~CNY 3,600/year), and Intelligence Partner (~CNY 9,600/year). Actual prices, benefits, and credit grants follow the checkout page and admin catalog at purchase time.

Billing cycles, taxes/invoices, refunds, and renewals follow the purchase UI and applicable law. After free quotas, some features may consume virtual credits. We do not invent fees that are not offered in product.

• We may interrupt or modify the service for maintenance, upgrades, force majeure, or third-party API changes;
• You may stop using the service and unlink accounts at any time;
• We may suspend or terminate for serious violations and reserve legal remedies.

• Jixin AI product, UI, brand, copy, and code belong to us or licensors;
• User content remains with users or rightful owners;
• TikTok, YouTube, Douyin, and similar names/marks belong to their owners and are used here for identification only.

• We do not promise every publish succeeds, appears instantly, or gains reach;
• We do not promise platform approval or continued public visibility;
• AI outputs may be inaccurate; verify important decisions manually;
• To the fullest extent permitted by law, we are not liable for indirect or consequential damages; liability that cannot be excluded by law remains.

These Terms are not a guarantee of revenue or marketing results.

You will indemnify us for reasonable losses arising from your breach of these Terms, infringement of third-party rights, or misuse of the service.

These Terms are governed by the laws of the People's Republic of China. Disputes should first be resolved amicably; failing that, they shall be submitted to a people's court with jurisdiction at the operator's domicile.
